Release of Liability & Waiver:
1. Assumption of Risk
I understand that participation in Brazilian Jiu Jitsu, martial arts training, conditioning, sparring, drilling, competitions, seminars, and related activities involves inherent risks, including but not limited to bruises, sprains, strains, fractures, dislocations, concussion, permanent injury, paralysis, or death. I knowingly, voluntarily, and expressly assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable, and whether caused by my own actions, the actions of others, or the conditions of the premises.
2. Release and Waiver of Liability
In consideration for being permitted to participate, I hereby release, waive, and discharge Billings Jiu Jitsu, LLC, its owners, officers, instructors, coaches, contractors, staff, agents, volunteers, training partners, and representatives (collectively, the “Released Parties”) from any and all claims, demands, or causes of action arising out of or related to my participation, including those arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by law. This release applies to injury, death, property damage, or loss occurring on or off the premises, during classes, open mat, events, seminars, demonstrations, travel to or from activities, or any activity connected with Billings Jiu Jitsu, LLC. This release does not apply to gross negligence or willful misconduct, which cannot be waived under applicable law.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation, conduct, or violation of gym rules or policies, including claims brought by third parties.
4. Medical Authorization
I certify that I am physically able to participate and have no medical condition that would prevent safe participation. In the event of an emergency, I authorize Billings Jiu Jitsu, LLC to obtain emergency medical treatment on my behalf if deemed necessary.
5. Photo and Video Release
I grant permission for photographs or video recordings of me to be used for instructional, promotional, or marketing purposes without compensation. This consent may be revoked only by written notice submitted to Billings Jiu Jitsu, LLC.
6. Governing Law and Venue
This agreement shall be governed by the laws of the State of Montana. Any legal action arising out of this agreement shall be brought exclusively in a court of competent jurisdiction located in the State of Montana.
7. Severability
If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8. Acknowledgment
I have read this agreement carefully, fully understand its contents, and sign it voluntarily, intending to be legally bound.
Minor Participant Addendum
I am the parent or legal guardian of the above-named minor. I consent to the minor’s participation and agree to all terms of this agreement on behalf of myself and the minor, including the release and indemnification provisions. I represent that I have full legal authority to execute this agreement.
